张盛闻:总警长藐视联邦宪法首相须革除其职位 The Prime Minister must act against the IGP for his contempt against the Federal Constitution

Chong Sin Woon(吉隆坡12日讯)马青总团长张盛闻上议员针对总警长卡立阿布峇卡表示,警方不会执行民事法庭的决定,并形容警方别无其他选择,就像是两套法律制度的“夹心人”的言论表示无法理解,他促请首相拿督斯里纳吉,如果总警察长不遵从民事法庭庭令,坚持不执行庭令的话,卡立阿布峇卡必须被革除总警长一职。

他指出,在近期发生的改教争抚养权的课题上,联邦宪法已经非常清楚的阐明,民事法庭的地位在伊斯兰法庭之上,警察部队负责的对象也是民事法庭,因此警方必须也只能执行民事法庭的庭令,轮不到警方去决定要不要执法。

“总警长在改教争抚养权的课题上,把警方形容为夹心人是非常不恰当和荒唐的,警方在执行任何的任务时,必须依据民事法庭的庭令行事,相反的伊斯兰法庭的庭令则由州宗教局执行,各施其职,互不干预”。

他表示,在改教争抚养权的课题上,总警长的立场却相反,他把民事法庭和伊斯兰法庭的决定混为一谈,以个人对联邦宪法的诠释来决定警方执行任务的标准,对我国警方的形象造成重大的打击和伤害。

“马青呼吁首相针对总警长的失职给予他最严厉的惩罚,卡立阿布峇卡的言论已经藐视联邦法定所赋予民事法庭和伊斯兰法庭的权限,他选择警方不会执行民事法庭的决定完全没有法律依据,有的只是非常牵强的理由”。

If Inspector General of Police Tan Sri Khalid Abu Bakar is unable to implement the order of the civil court by claiming that he is ‘sandwiched’ between the two legal systems of the civil court and syariah court, then Prime Minister Najib Tun Razak must take action to remove him from his position.

The Federal Constitution has made it very clear that the status of the civil court takes precedence over the syariah court, and as such the police are duty-bound to heed the civil courts’ orders. It is not their place to decide which law they wish to see enforced.

For Khalid to give the excuse that the police are stuck between a hard place and a rock in inappropriate. Regarding matters related to the civil court, it is the duty of the police to see it through, whereas for matters concerning the syariah court, it is handled by the respective state’s Islamic religious departments. Thus, the matter of clashing responsibilities does not arise.

Khalid’s action in using his own confused interpretation of the Federal Constitution to decide how the police should act has dealt a severe blow our police force’s image.

As such, MCA Youth hereby appeals to the Prime Minister to act against Khalid for dereliction of duty as he has tainted the image of the civil court by refusing the implement its court order without any proper legal basis.
